Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using BLKBK (the "App"), you agree to these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.

These Terms apply to all App features, including safety timers, check-ins, companion lookups, location sharing, SOS and emergency support resources.

2. Age Eligibility

• BLKBK is recommended for users aged 16 and over.
• You must be at least 16 years old to create an account and use the App.
• Age confirmation is done by self-declaration at signup. You must confirm via the on-screen prompt that you are at least 16 years old before any personal information is collected from you.
• The App does not use biometric ID scanning, government ID upload, or automated age-verification technology.
• Providing a false date of birth or age confirmation is a breach of these Terms and may result in account termination.
• The App is not directed at, and must not be used by, anyone under 16.
• We do not knowingly collect personal information from children under 16. If we learn we have collected data from a child under 16, we will delete it.
• If you believe an under-16 account exists, contact us at hello@blkbk.com.au.
• Local law override: In any country where the legal age of digital consent is higher than 16, the local higher age applies. You must meet that local requirement instead of the 16+ requirement.

3. Service Description

BLKBK is a personal-safety app for planning and tracking meetings, and for supporting safer interactions when meeting people in the real world.

BLKBK may help you:

• plan and store information about dates/meetings
• store private companion profiles
• share live location with selected people
• run safety timers and safety check-ins
• access emergency support resources, including SOS actions and designated emergency contacts (where you set them up)

What BLKBK does NOT do:

• BLKBK is not a matchmaking or dating service.
• BLKBK does not verify anyone's identity, background, or intentions.
• BLKBK cannot guarantee the safety of any in-person meeting.
• Any companion ratings, recommendations, or "unsafe" reports are based on community inputs and may be incomplete, inaccurate, or disputed.
• BLKBK does not automatically call or dispatch emergency services on your behalf. Where your safety preferences include emergency services, the App opens your device's phone dialler so that you can place the call yourself.
• Emergency alerts are sent only to emergency contacts who have explicitly accepted your emergency-contact consent request.

4. Accounts, PIN & Security

To use BLKBK, you must create an account. You register with your name, email, phone number, and a 4-digit PIN. Your PIN is used for authentication.

You must:

• provide accurate, current, and complete information
• keep your PIN and account secure
• not share your account or PIN with anyone else
• ensure your device and authentication settings are protected

You are responsible for all activity that occurs under your account. If you believe your account or PIN has been compromised, stop using the App and contact us as soon as possible at hello@blkbk.com.au.

5. In-App Purchases (EULA)

BLKBK provides two access tiers:

BLKBK LITE (free)

• includes: a safety timer, SOS, and companion lookups

BLKBK (full access)

• includes: BLKBK full access features as described in the App
• price: one-time purchase of $4.99 USD (or local-currency equivalent)
• NOT a subscription: no recurring charges, no auto-renewal, and no trial

How you pay

All purchases of BLKBK digital access are made exclusively through Apple's In-App Purchase (on iOS) or Google Play's billing system (on Android). We do not collect or store your payment details. Purchases are tied to your Apple/Google account.

Restore purchases

Full access is linked to your account. If you reinstall the App or switch devices, you can restore previous purchases using the restore option in the App.

Promo / redemption codes

Promo or redemption codes may grant full access at no charge.

Refunds and finality

Refunds are handled according to Apple's or Google's standard policies, as applicable. Except where required by the Australian Consumer Law or other applicable consumer law that cannot be excluded, all purchases are final. Where a refund may be available under applicable law, you may also email hello@blkbk.com.au with your purchase details and the reason for your request.

6. Safety Features (Disclaimer)

Our safety features are tools to assist your planning and response. They are not guarantees of safety.

You understand and agree that:

• BLKBK cannot guarantee your safety or prevent harm.
• Safety features depend on internet and mobile network connectivity and device performance.
• Location and GPS information may be inaccurate, delayed, unavailable, or affected by device settings, permissions, background behaviour, buildings, weather, terrain, map data, and signal conditions.
• Any automated messages, alerts, countdown timers, or communications may fail, be delayed, or not be received due to technical issues or limitations.
• Emergency-related actions within BLKBK do not replace contacting emergency services directly.
• BLKBK does not automatically call or dispatch emergency services. It can alert your consenting emergency contacts and open your device's phone dialler with the relevant emergency number so you can call yourself.

7. User Responsibilities & Prohibited Use

You agree to use BLKBK lawfully and responsibly, and only for its intended purpose. You must not:

• provide false, misleading, or inaccurate information
• use the App to harass, threaten, bully, or intimidate any person
• submit false emergency alerts, create nuisance alerts, or misuse SOS/check-ins
• use BLKBK to track, monitor, or invade a person's privacy without appropriate consent and lawful basis
• impersonate another person or misrepresent your identity
• attempt to reverse engineer, decompile, disassemble, hack, interfere with, or disrupt the App or its underlying systems
• use BLKBK on behalf of another person without the required consent and lawful authority

If we reasonably believe you have violated these Terms or used the App in a way that creates a safety risk, we may suspend or terminate your account as set out below.

8. User-Generated Content & Community Ratings

BLKBK may allow users to submit content such as companion safety ratings and recommendations, "unsafe" reports, and related safety feedback.

You agree that:

• Ratings, reports, and any safety information are community-generated and are not verified facts.
• BLKBK does not verify the truth of user-submitted ratings, reports, or allegations.
• Community ratings may be incomplete, inaccurate, or disputed.
• When you submit a rating or report, you must not make knowingly false statements or submit abusive, threatening, harassing, or unlawful content.
• BLKBK may moderate, remove, restrict, or edit user-generated content when we reasonably consider it necessary for safety, legal compliance, or to address misuse.

Submitting false or abusive reports or using the App to spread defamatory or harmful claims may result in suspension, termination, or other enforcement action.

9. Privacy & Data

Your use of BLKBK is also governed by our Privacy Policy. By using BLKBK, you consent to the processing of your personal information as described in the Privacy Policy. If there is any inconsistency between these Terms and the Privacy Policy, the Privacy Policy governs privacy and data processing.

10. Third-Party Services

BLKBK uses third parties to help operate and deliver parts of the App. This may include payment providers, messaging services (such as SMS or email), mapping and location services, push notification services, and cloud hosting and infrastructure providers. Third-party services are subject to their own terms and policies. Your use of those third-party services may also be governed by those providers' terms.

11. Intellectual Property

All content, branding, design, code, features, and functionality in BLKBK are owned by BLKBK or licensed to us.

Limited licence: We grant you a limited, personal, non-commercial licence to use the App on your device for your own use while you comply with these Terms. You must not copy, modify, distribute, sell, rent, lease, or create derivative works from the App or its content, except as permitted by law.

12. Disclaimers & Limitation of Liability

To the maximum extent permitted by law:

• BLKBK is provided on an "as available" basis.
• BLKBK does not provide safety guarantees.
• BLKBK is not responsible for harm arising from a meeting or date arranged using the App.
• Safety features may fail, be delayed, or not operate correctly due to technical issues, device limitations, connectivity problems, permissions settings, or other factors outside our control.
• Location/GPS data may be inaccurate, delayed, unavailable, or incomplete.
• Automated communications (including alerts, SMS, or calls, if enabled) may fail or be delayed.
• Data loss may occur due to technical failures or other issues.

Exclusion of consequential losses: To the maximum extent permitted by law, BLKBK will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from your use of the App.

Non-excludable rights: Nothing in these Terms excludes or limits liability that cannot be excluded under the Australian Consumer Law or other applicable consumer law that cannot be excluded.

13. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless BLKBK, its officers, employees, contractors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable legal costs) arising out of or connected with:

• your misuse of the App or safety features
• your breach of these Terms
• your violation of any law or infringement of any rights of another person
• user-generated content you submit (including companion ratings, reports, and "unsafe" allegations)
• your use of location sharing, check-ins, SOS, or emergency features in a way that breaches these Terms or causes harm

14. Suspension & Termination

We may suspend or terminate your account if we reasonably believe:

• you have breached these Terms
• your conduct creates a safety risk
• you use the App for harmful, unlawful, or abusive purposes
• you are under 16 or otherwise ineligible under these Terms or local law
• there is suspected fraud or misuse of the App

We may take action immediately where appropriate, including where there is an urgent safety concern.

15. Account & Data Deletion

You may delete your account and associated personal data yourself at any time directly in the App under Account Settings → Delete Account, which immediately removes your profile, dates, companions, alerts and history. You can also request deletion by emailing hello@blkbk.com.au. We will process email deletion requests within 30 days, subject to legal obligations and practical requirements (for example, security, fraud prevention, dispute resolution, and compliance with applicable law).

16. Refunds

BLKBK full access is a one-time purchase (not a subscription), paid through Apple's or Google's billing systems. Refunds are handled according to Apple's or Google's standard policies. Sales are final except where required by applicable consumer law that cannot be excluded.

17. Dispute Resolution

If you have a dispute with BLKBK, you agree to contact us first and try to resolve the dispute in good faith. Contact: hello@blkbk.com.au. You agree to allow us 30 days to respond and attempt resolution before starting legal proceedings (unless urgent relief is required). This does not affect your rights under Australian Consumer Law or other applicable consumer law.

18. Governing Law

These Terms are governed by the laws of Queensland, Australia. To the extent permitted by law, disputes will be handled through the courts of Queensland.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App and/or by email. If we make updates, you can continue using the App only if you accept the updated Terms. Continued use after updates means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

20. App Store / Google Play Terms

Your use of the App is also subject to the standard terms and conditions of the Apple App Store and Google Play. These Terms supplement those platform terms. Nothing in these Terms is intended to change your rights under Apple's or Google's standard EULA to the extent required by their terms and applicable law.
